Court upholds 10-year-sentence in stabbing death case

AMMAN — The Cassation Court has upheld a recent Criminal Court ruling sentencing a man to 10 years in prison after convicting him of attempting to kill his brother over a financial dispute in Zarqa.

The court declared the defendant guilty of stabbing his brother following a dispute over a bank guarantee at their home, and handed him the maximum sentence.

The tribunal acquitted a second brother from charges of attempted manslaughter for lack of evidence.

Court papers said that on the day of the incident, the victim argued with his brother about a bank guarantee that he took on his behalf, the court papers said.

The victim asked his brother to find someone else to take a bank guarantee instead of him, which angered the defendant, the court said.

“The defendant pulled a knife and stabbed his brother in the neck, chest and stomach,” the court transcripts added.

The Criminal Court attorney general contested the ruling saying that the court should consider the defendant’s actions premeditated.

However, the higher court ruled that it considered the incident as manslaughter and that “the Criminal Court ruling was sufficient and the defendant got what he deserved for his actions”.

 

The Cassation Court tribunal comprised justices Mahmoud Ababneh, Basel Abu Anzeh, Mohammad Ibrahim, Mohammad Tarawneh and Daoud Tubeleh.
